Chapter 1. General Provisions Article 1. (Purpose) These Terms of Use set forth basic rules concerning the terms and conditions, and procedures required in your use of the internet service provided by this Site (hereinafter referred to as the “Service”). Article 2. (Effectiveness and Modification) ① These Terms shall take effect once they are notified to you as the Site post them in the relevant service pages or other reasonable method. ① The Site may modify these Terms, and any changes made to the Terms shall be announced or notified to you in the same method prescribed in paragraph 1 to take effect. Article 3. (Definitions) The terms used herein shall have the meanings as follows: ① Member : A “Member” means an individual or a group that enters into the service agreement with the Site, or that is assigned a user ID by the Site. ① Applicant: An “Applicant” means an individual or a group that applies for membership registration at the Site. ① ID : “ID” means a combination of letters and numbers decided by each member and authorized by the Site. It is used for the Site to identify a user and provide the Service. ① Password : “Password” means a combination of letters and numbers decided by each member. “Password” is used for the Site to verify the identity of a user and protect their accounts. ① Termination : “Termination” means the service agreement is cancelled or terminated by either the Site or a member. Chapter 2. Service Agreement Article 4. (Formation of Agreement) ① By clicking the “Accept” button at the bottom of this page, you agree to and accept these Terms of Use. ① The Service Agreement shall come into effect when the Site approves and verifies your application to use the Service after you consent to these Terms of Use. Article 5. Sign up for Service: Application ① In order to use the Service, all applicants shall sign up for the Service by submitting their user information as required by the membership application form designated by the Site. ① Any and all user information required in the membership application form shall be considered as actual data of the applicant. A user who uses and submits other’s name and/or information will not be protected by the laws and the Site may refuse its Service. Article 6. (Approval of the Application) ① The Site will approve the service application submitted by an applicant, except any case that falls under any of the following paragraph 2 and 3 below. ① The Site may withhold its approval of the service application in any of the following cases until relevant cause is resolved: A. In case that there is no sufficient capacity to provide the Service; B. In case that a technical issue is detected; or C. In case that the Site deems to be necessary. ① The Site may refuse or disapprove an applicant’s service application if it finds out any the following cases: A. That the applicant uses and submits other person (or entity)’s name in the application; A. That the applicant submits a false information in the application; A. That the applicant applies for the Service for a purpose contravening the good and laudable custom of the society, and/or to harm public peace and order; or A. That information submitted by the applicant does not meet the requirements to use the Service. Article 7. (Change of User Information) In the event that your membership information is changed from what you have submitted initially for the membership application, you shall be responsible to correct it in your account as soon as possible. Any loss or damage incurred by you due to your failure to correct your member information shall be solely your responsibility, and the Site shall not be held liable in this regard. Prohibited Conducts You are specifically prohibited from the following conducts: ● Publishing any of this Website material in a third party media; ● Selling, sublicensing and/or otherwise commercializing any of this Website material; ● Publicly performing and/or showing any of this Website material; ● Using this Website in any way that is or may be damaging to the Website; ● Using this Website in any way that disrupt user access to the Website; ● Using this Website in a manner contravening applicable laws and regulations, or in any way that may cause harm to the Website, or to any person or an entity; ● Engaging in any data mining, data harvesting, data extracting or any other similar activities in relation to this Website; or ● Using this Website to engage in any advertising or marketing activities. Your access to certain areas of this Website is subject to restriction, and the Company, Mainline Co., Ltd., reserves a further right to restrict user access to any areas in the Website at any time, in its absolute discretion. Your user ID and password registered at this Website are confidential information and you must keep them in confidence at all times. Chapter 3. Obligations of the Parties Article 8. (Obligations of the Site) ① The Site shall provide the members with the following services: A. Sending out of the Company Newsletter about its new and the latest services, and domain related-information A. Entering members’ personal information automatically in case an additional domain is registered; and A. Various additional services necessary for domain registration and management. ① The Site shall neither disclose, publish, or distribute a member’s personal information which it received in relation with the provision of the Service to a third party without the member’s consent, nor use it for commercial purposes other than the purposes in relation to provision of the Service. Notwithstanding the foregoing, the following exceptions are applied: A. Information is requested by a government agency in accordance with applicable laws, such as the Framework Act on Telecommunications; A. Information is requested for criminal investigation purposes, or by the Korea Internet Safety Commission; or A. Information is requested in accordance with a due process prescribed by relevant laws or regulations. ① The Site has a duty to provide the Service, continuously and stably as set forth in these Terms of Use. Article 9. (Obligations of the Members) ① Members agree not to do or engage in any of the following activities: A. To use other member’s ID, illegally; A. To copy, utilize by changing, publishing, or broadcasting, or otherwise offer to a third party any information obtained from the Service without prior consent of the Site; A. To infringe any proprietary rights of the Site and/or a third party, including the copyright; A. To distribute to others any contents of information, texts, or graphic images that are in violation of public peace and order, as well as the good and laudable custom of the society; A. An activity that is objectively deemed to be related to a crime; or A. Any other activities that are in violation of applicable laws and regulations ① Members shall comply with applicable laws and regulations, provisions of these Terms, service guidelines and instructions. ① Members shall comply with prohibition requirements announced in the service message board in the site, or notified to them, individually. Chapter 4. Provision and Use of the Service Article 10. (Members’ Obligation to Manage their User ID and Password in Confidence) ① Managing your member ID and password in confidence is your own responsibility. As such, you shall be responsible entirely for any and all consequences arising from or in connection with your failure to keep your assigned ID and password in confidence, as well as any misuse or illegal use of your ID and password by another member. ① If you learn that your ID is misused or stolen by another, or notice a security violation in your account, you must notify the Site, immediately. Article 11. Force Majeure Events and Restriction or Suspension of the Service ① The Site may restrict or suspend the Service, in whole or in part, if there is an actual or a potential force majeure event, including a war, riot, natural disasters, or other national emergencies equivalent to the foregoing, or suspension of telecommunication service provided by a facilities-based telecommunications business entity pursuant to the Telecommunications Business Act, ① In the case of service suspension or restriction under paragraph 1 above, the Site shall notify the members of the reason and the period of service suspension/restriction, without delay. Chapter 5. Modification and Termination of the Agreement Article 12. (Modification of Information) If necessary, you may modify your member information, including mailing address and password, by using the member information change service at the main page of this Website. Article 13 (Termination of the Agreement) As a member, you may terminate the Service Agreement either directly by taking the termination procedures at the Site, or requesting it to the Site through telephone or online inquiry. Your access to the Service will be restricted by the Site on the date when your request is received. The Site may also terminate the Service Agreement with a member if it finds the member is in any of the following situations, by giving a seven (7) day notice to the member with an opportunity to explain and rectify the issue: ① The member is in breach of the prohibition requirements prescribed herein, or fails to correct the default situation or resolve the cause of violation; ① Termination is required by the Korea Internet Safety Commission; ① The member fails to reply to the request of explanation without a justifiable reason; or ① It is found that the member has registered by using another’s name or entered into the Service Agreement by submitting false information or document materials. As for the members whose membership is terminated by the Site due to any of the aforementioned reasons, the Site reserves the right to limit a further membership registration of the member for a certain period of time. Chapter 6. Exemption from Liability Article 14 (Indemnification) ① The Site shall neither be held liable or responsible for any unsatisfied profits expected by you from the Service, nor for any loss or damage incurred by you due to your choice of the Service option or selective use of the Service materials. ① The Site shall not be held liable or responsible for service disruption, or loss or damage of members’ data cased by a reason attributable to the members or an intentional act of a third party. ① The Site shall not be held liable or responsible for the content posted or transmitted by its members. ① Any risk of loss, damage, claims, or liabilities arising in connection with or relating to a trademarked domain shall be borne by you when you purchase the domain. In no event, the Site shall be held liable in this regard. Article 15 (Jurisdiction) Any disputes arising out of or in connection with the Service between you and the Site shall be submitted and resolved by a court of competent jurisdiction in which the head office of the Site is located. [Addendum] (Effective Date) These Terms of Use shall come into effect as of January, 2019.
